Chapter 10
Legal pages for Switzerland, Germany and Austria
An overview of what to think about before you start selling. It does not replace legal advice.
What the template already has
The shop templates include pages for the imprint, privacy policy and terms of sale, linked in the footer. They are a framework with placeholders, not finished texts. Replace the content entirely with your own details.
Imprint
If you sell online, you have to say clearly who is behind the shop. Usually at least:
- the name of your business or your own name, and the legal form
- a postal address (not a PO box)
- an email address
- if applicable: commercial register entry, UID or VAT number
In Switzerland this follows from the Unfair Competition Act (UWG), in Germany from the Digital Services Act (DDG) and in Austria from the E-Commerce Act and the Media Act.
Privacy policy
It explains which data you collect, what for and who receives it. In Switzerland the Data Protection Act (DSG) applies, and for customers in the EU also the GDPR. List every service that processes your visitors' data, for example:
- Framer as the host of your site and for forms
- Stripe for payments
- the kspr studio checkout service, which passes the order on to Stripe
- your newsletter service, if you use one
- analytics or marketing services, if you add any
The kspr studio checkout service passes the cart on to Stripe. Orders, payments and customer details live in your Stripe account. Which data the service processes along the way is set out in the kspr studio privacy policy and the plugin terms.
If you add analytics or marketing services that set cookies, you may need your visitors' consent first, depending on the country.
Terms of sale
They set out how a purchase works. Typical points:
- contracting party, ordering process and payment methods
- prices, shipping costs, delivery time and delivery area
- warranty, returns and exchanges
- Right of withdrawal: customers in the EU can usually withdraw from online purchases within 14 days. This requires withdrawal instructions and a model withdrawal form. There are exceptions, for example for perishable goods or sealed goods that cannot be returned for hygiene reasons. Switzerland has no general statutory right of withdrawal for online purchases, though many shops offer one voluntarily.
Prices and the order button
- Show final prices including VAT if you are registered for VAT, and state shipping costs before the purchase.
- In Germany, the final button must make it clear that the order costs money. Check with your adviser whether the label in Stripe Checkout works for you.
- If your terms require consent or you need an age confirmation, use the checkout's required checkbox (shipping, tax and options).
Food and cosmetics
If you sell food, the mandatory information (ingredients, allergens, nutrition facts, manufacturer) has to be on the product page before the purchase, not just on the packaging. Cosmetics have their own labelling rules. The templates' product pages have expandable sections for this.
